Lasting Power of Attorney

These documents are often created at the same time that you make a Will. They are very simple doucments that enable your family or appointed representative to take over your affairs in the event that you become incapacitated. The Lasting Power of Attorney can not be enforced until any such illness occurs and even then, they are totally secure because members of your family have to be informed that the Lasting Power of Attorney is to be registered. The Lasting Power of Attorney document then has to be lodged with the Court of Protection before it can be used. Please note the Enduring Power of Attorney has now been replaced by the more secure but more complex Lasting Power of Attorney. Enduring Power of Attorney's signed before the 1st Oct 2007 are still valid.
